Terms of use

1. Purpose
These terms govern the use of the Kwitt application (the “service”), operated by Nathan Küpfer, 2013 Colombier (“we”). By creating an account, you accept them.
2. The service
Kwitt lets you create, send and track invoices for a business based in Switzerland or Liechtenstein: invoices with a QR payment part, clients, catalogue, subscriptions, reminders, credit notes, VAT statement and exports.
The service is currently in beta: it changes regularly, features may be added, modified or removed, and interruptions are possible.
3. Your account
- You must have full legal capacity or, failing that, the consent of your legal representative.
- The information you provide must be accurate and kept up to date.
- You keep your password confidential and are responsible for the use of your account. Let us know without delay of any misuse.
4. Prices
The service is free during the beta. The prices that apply afterwards will be announced to you in advance by email. You will then be free to continue under the new terms or to stop using the service, at no cost.
5. Your responsibilities
Kwitt helps you prepare your invoices, but you remain responsible for their content and for meeting your obligations, in particular:
- the accuracy of the amounts, VAT rates and statements on your invoices;
- whether you are liable for VAT, and your returns to the Swiss Federal Tax Administration (FTA);
- keeping your invoices and accounting records for ten years (art. 958f of the Swiss Code of Obligations);
- your right to process the client data you enter.
The explanations and texts suggested by the application are general information. They do not constitute legal, tax or accounting advice. If in doubt, consult a fiduciary or the FTA.
You undertake not to use the service for unlawful purposes, for example to issue false invoices, and not to disrupt its operation.
6. Your clients’ data
For your clients’ personal data that you enter, you are the controller and we act as processor (art. 9 FADP). As such, we undertake to:
- process this data only to provide you with the service, according to your instructions;
- keep it confidential and protect it with appropriate security measures;
- use only the providers listed in our privacy policy, who are bound by the same obligations;
- help you respond to requests from the persons concerned;
- inform you without delay of any security breach affecting it;
- delete it at the end of our relationship, after letting you export it.
7. Availability and backups
We do our best to keep the service available and your data backed up, but cannot guarantee uninterrupted availability during the beta. We recommend downloading your invoices as PDF and exporting your data from the application regularly.
8. Intellectual property
The application, its code, its texts and its design belong to us. You receive a personal, non-transferable right of use for the lifetime of your account. The data and documents you create remain yours.
9. Liability
To the extent permitted by law, we accept no liability for indirect damage, loss of profit, loss of data or the consequences of errors in invoices prepared with the service. Our liability for damage caused intentionally or through gross negligence remains reserved.
10. End of use
- You can stop using the service and delete your account at any time from your profile. Remember to export your data first.
- We may suspend or close an account if these terms are breached, or end the service with at least 30 days’ notice to give you time to export your data.
11. Changes
We may change these terms. Significant changes are announced to you by email before they take effect. If you continue to use the service afterwards, you accept the new version.
12. Governing law and jurisdiction
These terms are governed by Swiss law. The place of jurisdiction is the registered office of the operator, subject to the mandatory places of jurisdiction provided by law, in particular for consumers.
